ZEST COURIERS GHANA LTD. is a limited liability company registered under the laws of the Republic of Ghana. Zest Couriers GH was set up essentially to pick up, transport and deliver food, groceries, documents, goods, parcels and packages from one point to all other parts of the Country and across the sub-region upon the request of our cherished clients.

2.0 Terms and Conditions
2.1 Services
Zest Couriers GH exists to provide reliable courier and logistics services in Ghana, the sub-region and across other parts of Africa. However, Zest Couriers GH does not carry all forms of prohibited items and does not do delivery to places which are not easily accessible by motorcycles or vehicles. We do not also carry physical cash in whatever form of package.
2.2 Obligations
The customer shall package and label the parcel appropriately, provide accurate information on recipient's physical address and mobile phone number, and must avoid sending prohibited goods. Zest Couriers GH shall NOT be liable for damages that may occur as a result of poor packaging, wrong package description or inappropriate labelling.
Zest Couriers GH shall transport and deliver parcels to their destinations upon the payment of the requisite fee and compliance with packaging requirements.
2.3 Payment Terms
The customer agrees to pay the appropriate fees for the services of Zest Couriers GH as provided for in its schedule of fees accessible on the company's website. Payments shall be made in Ghana Cedis (GH₵) or dollar equivalent (USD $) in compliance with Bank of Ghana regulations.
Payments may be made ONLY through the specified modes or methods agreed to, and to the designated staff/officer of Zest Couriers GH only. Payments shall be made before delivery, except as otherwise agreed with the customer, and Zest Couriers GH reserves the right to refuse delivery on grounds of non-payment or late payment of fees.
2.4 Refund Policy
Save as hereinafter expressly stated, all payments made are not refundable. However, Zest Couriers GH is open to refund for losses or damages that are established to have occurred due to the negligence of its service delivery personnel and partners. Such refund claims shall be made, in writing, within ten (10) working days.
2.5 Prohibited Items
Zest Couriers GH does NOT accept to carry goods generally prohibited by law, hazardous materials and or substances, highly inflammable chemicals and explosives as well as expired food products. Zest Couriers GH reserves the right to open parcels (in the presence of the sender-customer) where necessary, if it had reasonable cause to suspect a violation of the conditions herein.
2.6 Delivery Time
Delivery time is not fixed and shall be subject to other factors such as road conditions, weather, customs checks or inspections, and the traffic situation in the case of major cities. Zest Couriers GH shall therefore not be liable for losses that may occur due to delay, except otherwise agreed.
2.7 Liability
Zest Couriers GH accepts liability for loss of an item/parcel, or for damages occasioned by the negligence of its officers.
2.8 Force Majeure
Zest Couriers GH shall NOT be liable for any delay or failure to meet its obligations (other than refund obligations) under this Terms & Conditions due to an event of Force Majeure or any cause outside its reasonable control, including (without limitation), any acts of God, riot, malicious acts of damage by third parties, civil commotion, strike, lock out or industrial action, unavoidable road accidents, fire outbreak, delays by regulatory authorities, acts of a public enemy, declared or undeclared war, threat of war, terrorist acts, blockade, revolution, riot, insurrection, civil commotion, or public demonstration.
2.9 Breach and Termination
The failure of a Party to perform any of its obligations under this Terms & Conditions shall constitute a breach. Where a Party is in breach of any of its obligations under this Terms & Conditions, the Party not in breach shall give notice in writing to the defaulting Party requiring that the breach be remedied within ten (10) working days of the date of the said notice. But where the said Party fails, refuses or neglects to remedy the breach within the specified period, the other Party shall be entitled to terminate the contract.
2.10 Continuation Obligation
Upon the termination of the contract by a Party pursuant to any of the events described above, none of the Parties shall have any obligations to the other Party under this Terms & Conditions, except those that have accrued prior to termination of the contract.
2.11 Waiver
The failure by either Party to enforce at any time or for any period any one or more of these terms and conditions shall not be a waiver of them or of the right at any time subsequently to enforce all the terms and conditions.
2.12 Dispute Resolution
Any dispute, controversy, claim, or difference arising out of, or in connection with, or resulting from this Terms & Conditions, its application or interpretation, or a breach thereof, which cannot be settled amicably by the Parties, shall be resolved definitely and exclusively by Arbitration under the Alternative Dispute Resolution Act, 2010 (Act 768). Any award, order or judgment pursuant thereto is final and may be entered and enforced in any court of competent jurisdiction. Each party shall submit to any court of competent jurisdiction for purposes of enforcing any award, order or judgment.
2.13 Severability
If any provision of this Terms & Conditions is held to be invalid, or unenforceable, the remaining provisions shall remain in force and effect.
2.14 Governing Law
This Terms & Conditions shall be governed by the laws of the Republic of Ghana.
